THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF CHOPT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by gross negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

The arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The AAA's rules are available at www.adr.org. The arbitration shall be conducted in the English language. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.2 Class Action Waiver

YOU AND CHOPT EXPRESSLY WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION OR CLASS-WIDE ARBITRATION. All disputes must be brought solely in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

11.3 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Either party may also bring individual claims in small claims court if the claim qualifies and remains in that court.

11.4 Opt-Out Right
